1. Model-based premium estimates derived from SygmaData's independent methodology using public and historical regulatory filing information and other lawful inputs
2. Informational comparison tools showing modeled pricing bands using carrier references for general market context
3. Informational insights into rating factors that may influence insurance premiums
4. Historical estimate tracking over time

2. Important Disclaimers

THE ESTIMATES PROVIDED BY SYGMADATA ARE MODEL-GENERATED APPROXIMATIONS AND ARE NOT INSURER-ISSUED QUOTES, OFFERS, GUARANTEES, ELIGIBILITY DETERMINATIONS, OR RECOMMENDATIONS TO PURCHASE FROM ANY INSURER.

1. Estimates are derived from SygmaData's independent model using public and historical regulatory filing information and other lawful inputs. They may differ from actual carrier premiums.
2. SygmaData is not an insurance company, insurance agency, insurance broker, or insurance agent, and does not sell, solicit, negotiate, quote, bind, or place insurance.
3. SygmaData does not provide insurance advice, legal advice, financial advice, or recommendations regarding any specific insurer, policy, coverage selection, or purchase decision.
4. Users are solely responsible for verifying pricing, eligibility, coverage, and underwriting outcomes directly with licensed insurers or licensed insurance professionals before making any insurance-related decision.
5. Certain carrier-specific public eligibility notes (for example, publicly known membership limitations) may be referenced for general market context, but SygmaData does not determine eligibility, approval, or availability.
6. We do not guarantee the accuracy, completeness, or timeliness of any estimate or analysis.

3. Account Registration and Security

To use our services, you must create an account. By registering, you agree that:

1. You will provide accurate, current, and complete information during registration and when entering your insurance profile
2. You are solely responsible for maintaining the confidentiality of your password and account credentials
3. You will notify us immediately of any unauthorized access to your account
4. You are responsible for all activity that occurs under your account
5. You are at least 18 years of age

We reserve the right to suspend or terminate accounts that violate these Terms, are used fraudulently, or have been inactive for an extended period.

4. Subscription Tiers and Billing

We offer the following service tiers:

1. Free: Limited access (limited estimate view, basic features)
2. Pro ($7.99/month or $71.88/year): Expanded estimate summary, confidence ranges, carrier reference ratings, and estimate comparison tools
3. Premium ($14.99/month or $143.88/year): All Pro features plus What-If estimate simulator, informational rating factor insights, historical estimate tracking, estimate update tracking, and priority support

Subscription pricing is subject to change. We will notify users of pricing changes before their next billing cycle. You may upgrade, downgrade, or cancel your subscription at any time. Downgrades take effect at the end of the current billing period.

Annual subscriptions provide a 25% discount compared to monthly billing. All subscription charges are processed securely through Stripe.

5. Cancellation and Refunds

You may cancel your subscription at any time. There are no contracts and no cancellation fees.

1. Monthly Subscriptions: When you cancel a monthly subscription, your paid plan remains active until the end of the current billing period. After that date, your account automatically reverts to the Free tier. No refund is provided for the remaining days in the current billing period.
2. Annual Subscriptions: When you cancel an annual subscription, your paid plan remains active through the end of the current calendar month from the cancellation date. You will receive a prorated refund for any remaining unused months in your annual subscription, automatically returned to your original payment method within 5-10 business days.
3. Downgrades: If you downgrade from a higher tier to a lower tier, the downgrade takes effect at the end of your current billing period. You retain access to your current tier's features until that date.
4. Refund Policy: Refunds are only provided for cancelled annual subscriptions as described above. Monthly subscriptions are not eligible for refunds. We do not provide refunds for partial months of service.
5. Account Termination by Sygma: If we terminate your account due to violation of these Terms, you are not eligible for any refund of prepaid subscription fees.

You can manage your subscription, update your payment method, view invoices, and cancel your plan through the Stripe billing portal accessible from your account settings.

6. Acceptable Use

You agree not to:

1. Use the Site for any unlawful purpose or in violation of any applicable law
2. Provide false or misleading information in your insurance profile
3. Attempt to gain unauthorized access to the Site, other user accounts, or our systems
4. Reverse engineer, decompile, or disassemble any part of the Site or its estimation algorithms
5. Use automated tools (bots, scrapers, spiders) to access or extract data from the Site
6. Interfere with or disrupt the Site's infrastructure or impose an unreasonable load on our systems
7. Copy, redistribute, sell, or commercially exploit any content, estimates, or data from the Site
8. Impersonate another person or misrepresent your affiliation with any entity

7. Intellectual Property

All content on this Site — including the AI estimation engine, algorithms, user interface, text, graphics, logos, and software — is the property of Sygma Data, LLC. and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works based on our content or technology without prior written consent from Sygma.

8. Your Data

You retain ownership of the personal information you provide to our platform. By using the Site, you grant Sygma a limited, non-exclusive license to use your data solely for the purpose of providing and improving our services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Sygma Data, LLC. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

1. Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site
2. Any loss or damage resulting from reliance on model-generated estimates, analysis, or any content provided through the Site
3. Any insurance-related decisions made based on our estimates
4. Any unauthorized access to or alteration of your data
5. Any interruption or cessation of service

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO SYGMA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Sygma Data, LLC. and its directors, officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

1. Your use of the Site or violation of these Terms
2. Your violation of any third-party rights
3. Any content or information you provide through the Site

12. Disclaimer of Warranties

THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, or that any estimates will be accurate or complete.

13. Termination

We may suspend or terminate your access to the Site at any time, with or without cause, and with or without notice. Upon termination, your right to use the Site ceases immediately. Sections 2, 7, 10, 11, 12, and 15 survive termination.

We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting. The "Last updated" date at the top of this page will be revised accordingly. Your continued use of the Site after changes constitutes acceptance of the updated Terms. We will make reasonable efforts to notify users of material changes via email or on-site notification.

15. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Georgia, USA, without regard to conflict of law provisions. Any dispute arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Fulton County, Georgia.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
